Terms and conditions

These terms explain how postal orders, subscriptions, custom-cake enquiries and local orders are handled.

2. These terms

These terms apply to orders placed through the Monkey Bakes website and to custom-cake or local-bakes orders subsequently agreed following an enquiry.

Please read these terms, the product information, delivery information and allergen information before ordering.

3. Products and descriptions

Monkey Bakes takes reasonable care to describe products accurately. As products are handmade, there may be small variations in appearance, decoration, colour, size or finish.

Product photographs are illustrative. Screen settings and the handmade nature of the products mean colours and appearance may vary.

Availability, ingredients and branded components may change. Relevant information provided with the product should always be checked before it is eaten.

4. Prices

Website product prices are shown in pounds sterling. Standard postage for postal products is included unless the website clearly states otherwise.

Prices described as “starting from” are guidance. The final price of a custom or local order depends on its size, flavour, filling, decoration and other agreed requirements.

An obvious pricing error does not require Monkey Bakes to supply a product at the incorrect price. If an error affects an order, the customer will be contacted before the order is accepted or prepared.

5. Placing an online order

Customers are responsible for checking their basket, contact information, delivery address, dispatch date and allergen information before completing payment.

An automated acknowledgement confirms that an order request has been received. A contract is formed when Monkey Bakes accepts the order and payment has been successfully confirmed.

Monkey Bakes may refuse or cancel an order before preparation where the product is unavailable, capacity is exceeded, payment cannot be confirmed, delivery is not possible or there is a genuine safety concern.

If Monkey Bakes cancels a paid order, the affected payment will be refunded.

6. Payment

Online payments are processed securely through the payment provider shown at checkout. Monkey Bakes does not directly store complete payment-card details.

An order is not confirmed unless payment has been successfully authorised, except where a different arrangement has been expressly agreed for a custom or local order.

7. Capacity and dispatch dates

Postal orders are subject to weekly production capacity. If the next dispatch is full, the website may offer a later available date.

Customers should check the scheduled dispatch date before paying. Orders placed from Monday to Sunday are normally prepared for the next available Thursday dispatch.

8. Delivery

Postal orders are dispatched with the intention of arriving on Friday, but arrival on a particular day cannot be absolutely guaranteed once a parcel is with the postal or courier service.

Customers must provide a complete and accurate delivery address. Monkey Bakes is not responsible for a failed or delayed delivery caused by incorrect or incomplete information supplied by the customer.

Responsibility for the parcel passes to the customer when it is delivered to the address supplied or to an authorised safe place or recipient.

9. Cancellations and changes

Cakes and baked goods are perishable. Custom cakes and personalised products are also made to the customer’s requirements. The ordinary change-of-mind cancellation right generally does not apply to perishable or personalised goods.

Please contact Monkey Bakes immediately if you need to request a change or cancellation. Requests will be considered where possible, but cannot be guaranteed once ingredients have been ordered or preparation has started.

Nothing in these terms limits a customer’s legal rights when goods are faulty, damaged, unsafe or not as described.

10. Problems with an order

Open postal parcels promptly and check the contents. If an item arrives damaged, incorrect or otherwise unsuitable because of a fault, contact Monkey Bakes as soon as reasonably possible.

Please retain the product and packaging and provide clear photographs where requested. This helps Monkey Bakes investigate the delivery and offer an appropriate resolution.

Do not consume a product that appears unsafe, damaged or different from the allergen information supplied.

11. Allergens

Customers must review the relevant allergen information before ordering and before eating a product.

Products are prepared in a kitchen that handles multiple allergens. Monkey Bakes cannot guarantee that a product is free from traces or cross-contamination.

Monkey Bakes does not currently offer gluten-free cakes or bakes.

12. Mystery boxes

The contents of a mystery box may vary. Photographs and previous boxes do not guarantee the contents of a future box.

Where allergy or preference information is supplied, Monkey Bakes may replace an item directly containing the specified ingredient with another available item. A replacement is not guaranteed to be free from traces or cross-contamination.

13. Subscriptions

Subscription payments must be confirmed before the corresponding order is dispatched.

If a payment fails, Monkey Bakes may send a reminder and allow a two-day payment period. If payment remains unsuccessful, the subscription may end automatically and the customer will be notified.

Customers can request an available skip or manage future deliveries through the subscription-management page.

A change or cancellation applies to future deliveries subject to the applicable processing date. Products already prepared or dispatched cannot normally be cancelled as a change-of-mind request.

Statutory consumer rights are not affected.

14. Custom cakes and local bakes

Sending an enquiry does not reserve a date, create an order or guarantee availability.

A custom cake or local order is booked only after Monkey Bakes has confirmed the details and price and any required payment has been received.

Inspiration photographs are used as references. An exact copy of another baker’s work cannot be guaranteed.

15. Events outside reasonable control

Monkey Bakes will not be responsible for a delay or failure to fulfil an order where, and only to the extent that, it is caused by an event outside our reasonable control that we could not reasonably have prevented or avoided.

Such events may include, but are not limited to, severe weather, flood, fire, natural disaster, epidemic, pandemic, public-health emergency, government or local-authority action, postal or courier disruption, interruption of essential utilities, an unavoidable supply-chain failure, or sudden serious illness or injury.

If an order is affected, Monkey Bakes will contact the customer as soon as reasonably possible and take reasonable steps to reduce the disruption. Where possible, a revised collection, delivery or dispatch date will be offered.

If the affected order cannot reasonably be fulfilled, Monkey Bakes or the customer may cancel the affected order. The customer will receive a refund for any goods paid for but not supplied.

This section does not apply to circumstances within Monkey Bakes’ reasonable control, and it does not limit any statutory rights or liability that cannot legally be excluded.

16. Legal rights

Nothing in these terms excludes liability that cannot legally be excluded or restricts the customer’s statutory consumer rights.

These terms are governed by the laws of England and Wales. Customers retain any mandatory consumer protections that apply to them.
